1. Introduction

The Resilience Group (“TRG”, “we”, “us” or “our”) respects your privacy and is committed to protecting the personal information you share with us. This policy explains how we collect, use, store, share and safeguard personal information, and the rights available to you.

This policy is drafted in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and the Electronic Communications and Transactions Act 25 of 2002 of the Republic of South Africa.

2. Information we collect

We collect information you provide directly to us, such as your name, organisation, role, email address, telephone number and the content of any enquiry submitted through our consultation form or by email.

We may also collect technical information automatically when you visit our website, including your IP address, browser type, device information, referring pages and pages visited, for security and analytics purposes.

3. How we use your information

We process personal information to respond to enquiries, arrange and conduct consultations, deliver contracted services, issue invoices, maintain client records, improve our website and services, and send relevant professional communications where you have consented to receive them.

We only process personal information for a lawful purpose connected to our functions and activities, and we do not use it in a manner incompatible with the purpose for which it was collected.

4. Lawful basis for processing

We rely on one or more of the following bases: your consent; the performance of a contract with you; compliance with a legal obligation; the protection of a legitimate interest; or the pursuit of our legitimate interests, or those of a third party to whom the information is supplied.

5. Sharing and disclosure

We do not sell personal information. We may share personal information with trusted service providers who assist us in operating our business (for example hosting, email, scheduling and accounting providers), with professional advisors, or where required by law or a lawful request from a public authority.

Where a service provider processes personal information on our behalf, we require appropriate confidentiality and security commitments from that operator.

6. Cross-border transfers

Some of our service providers may store or process information outside South Africa. Where this occurs, we take reasonable steps to ensure that the recipient is subject to laws, binding corporate rules or agreements that provide an adequate level of protection substantially similar to POPIA.

7. Security safeguards

We apply appropriate, reasonable technical and organisational measures to prevent the loss of, damage to, or unauthorised destruction of personal information, and unlawful access to or processing of personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Retention

We retain personal information only for as long as is necessary to fulfil the purpose for which it was collected, or for as long as required by law, contract or legitimate business need, after which it is securely deleted or de-identified.

9. Your rights

You have the right to request access to the personal information we hold about you, to request correction or deletion of that information, to object to processing, and to withdraw consent to direct marketing at any time. Requests can be made using the contact details below.

You also have the right to lodge a complaint with the Information Regulator (South Africa) at enquiries@inforegulator.org.za.

10. Cookies

Our website may use cookies and similar technologies to support core functionality and to understand how the site is used. You can set your browser to refuse cookies, although some parts of the site may then not function as intended.

We may update this policy from time to time. The revised version will be published on this page and applies from the date of publication.
